Backup and Data Agreement

Switzer Enterprises strongly advises that any and all users of electronic devices safeguard their critical data by means of recoverable data backup. The Client is responsible for the data on this device being safeguarded before surrendering it for service. Switzer Enterprises will endeavor to take all reasonable action to ensure that existing data remains in a state most similar as possible upon completion of service to the state in which it arrived. The Client acknowledges that in the case of hardware failure, data corruption, or other scenarios in which damage or degradation is present on the device at time of arrival that there may be critical and unrecoverable loss of data. In terms of data loss, or other malignant data incident, the Client agrees to release from liability, hold harmless, and indemnify Switzer Enterprises, its agents, and its representatives for any loss of data and/or damage (actual, reputational, financial, or otherwise) that may arise from malicious data, software, or malware present on the system.

Billing Terms

Billing Terms: Computer Diagnostic and Backup services are billed at the minimum of one hour of labor at the current rate of $125 per hour. Provided that the Client's data is in an accessible state and on appropriately functioning media, Switzer Enterprises will perform an Image backup of the Client's data which will be stored on Switzer Enterprises servers for the sole and express purpose of safeguarding the Client's data. If an image backup is not possible due to any reason Switzer Enterprises may determine, a file backup will be completed. Note that should the operating system or file system become unrecoverable during service where an image backup is unable to be completed, licensed programs may lose their operating licenses, if they are able to be restored at all. Switzer Enterprises is not responsible for compensation or remuneration for program licenses lost during execution of service. Upon client receipt of the device and payment, the data backed up to Switzer Enterprises servers will be held for 30 days, after which time it may be destroyed at the operating technician's discretion. Upon completion of diagnosis, an estimate of cost for return to desired level of service will be provided. Estimates are not guaranteed. Estimate service is given as a cost in addition to the $125 minimum diagnostic and backup fee. In the event that actual cost will exceed estimated cost, every reasonable effort will be made to contact the Client via telephone or email to secure the Client's express approval before engaging in services in excess to the estimated cost. If Switzer Enterprises cannot contact the Client, all work will stop until contact is made or the above 90 day abandonment date is reached. In the event that there is an additional cost necessary for repair of the device and the Client does not agree to the additional cost, Switzer Enterprises will return the device to as close to the condition it was in upon receipt without incurring any further billable labor. The minimum cost of $125 will still be due to collect any devices where repair was declined. Payment Terms: Payment in full is due upon completion of services, upgrades, or repairs. Computer parts, hardware, or software that are special ordered must be paid at retail cost in advance. Failure to do so will be treated as a declined service, with the minimum cost of $125 still being due before collection. Unclaimed Property Notice: Customers must pickup and pay for services rendered within thirty (30) days of service completion. If a device is not picked up within thirty days, a storage fee of $5.00 per day will be charged in addition to the original fee. Devices, peripherals, and other equipment left behind without contact or correspondence will be treated as abandoned, in accordance with California state law. Abandoned devices will be sold, recycled, or parted out to recover as much of the non-payment as possible. Remaining non-payment is due before any further or future service will be rendered.
